Welcome to GeoBirds


Thank you for your interest in GeoBirds. GeoBirds develops an AI driven supply chain intelligence platform that gives logistics service providers deeper insight into production and warehouse locations, transport flows, and potential customers. Based on these insights, our customers can use their networks more efficiently, identify commercial opportunities, and optimise their go to market strategy.

We take the privacy and security of your personal data seriously. This Privacy Notice explains, in clear and plain language, how we handle your personal data when you interact with us. The GeoBirds platform is intended for business use and should not be used if you are under 18.


Purpose of this document


Through this Privacy Notice, we want to inform you about how we safeguard the security and protection of your data, and how we comply with the applicable laws on privacy and the protection of personal data, such as the European General Data Protection Regulation (GDPR).

This Privacy Notice applies to the personal data that GeoBirds processes as a data controller. Where GeoBirds processes personal data on behalf of a business customer as a data processor, for example personal data that a customer uploads to or stores in the platform, that processing is governed by the data processing agreement with that customer. Where GeoBirds itself decides which personal data to collect and for what purpose, including the business contact details we make available through the platform, we act as controller and this Privacy Notice applies.


Who this Privacy Notice covers


This Privacy Notice covers three groups of people:

  • Users of the GeoBirds web application;

  • Business contacts at organisations we work with or would like to work with, whose details we hold in our customer relationship management system;

  • Professional contacts at logistics and shipping organisations whose business contact details we make available to our customers on request through the GeoBirds platform.

If you belong to group 3 and have never used the GeoBirds platform, the section Professional contacts shown in the GeoBirds platform explains what we do, where the information comes from, and how to object.


The GeoBirds web application


GeoBirds provides its platform as a web application that you access through your browser. To give you access, we operate a secure user account system. When you log in and use the GeoBirds web application, we process the account information and usage data described in this notice.

The platform itself analyses satellite imagery and logistics data about sites, facilities, and freight flows. This information primarily relates to locations and buildings rather than to identifiable individuals. Where a customer asks for professional contacts associated with a site, the platform can also show business contact details of individuals.


What personal data we collect


When you use the GeoBirds web application, we collect the Personal Data (as defined below) that you share with GeoBirds. In this Privacy Notice, Personal Data means information that can be used to identify you, such as your name, email address, and phone number. The types of Personal Data we collect will depend on the specific website function that you use. For instance:

  • Identity and contact data: name, business email address, phone number, job title, employer;

  • Account data: username, login credentials, account preferences;

  • Communications data: messages, support requests, and correspondence you send us;

  • Usage and technical data: IP address, device and browser type, pages viewed, and actions taken in the web application.

We may also collect business contact details about you from other sources when we identify organisations and professional contacts that may be interested in our services. In that case the categories of Personal Data are business name, professional role, and business contact details, and the sources are public business registers, company websites, and the organisation's own website.


For which purposes does GeoBirds use your personal data and why is this justified?


GeoBirds will use the collected information for the following specific purposes:

  • To operate the GeoBirds web application and support our business activities;

  • To create and administer your account and to give you access to the GeoBirds web application;

  • To provide, maintain, and improve the platform and its features;

  • To respond to your questions and to provide customer support;

  • To manage our relationship with you or the organisation you represent, including billing and invoicing;

  • To identify and contact organisations and professional contacts that may be interested in our services;

  • To provide our customers, at their request, with business contact details of professional contacts at organisations they are researching;

  • To keep the platform secure and to prevent fraud or misuse;

  • To comply with our legal and regulatory obligations.

We will not process your personal data if we do not have a proper justification foreseen in the law for that purpose. Therefore, we will only process your personal data if:

  • the processing is necessary to perform our contractual obligations towards you or the institution you represent;

  • the processing is necessary for our legitimate interests and does not unduly affect your interests or fundamental rights and freedoms;

  • you have given your consent for a specific purpose, which you can withdraw at any time; or

  • the processing is necessary to comply with a legal obligation.

Where we ask you to provide personal data to comply with a legal requirement or to enter into a contract with you, we will make this clear at the relevant time. If you choose not to provide personal data that is necessary to create or manage your account, we may be unable to give you access to the GeoBirds web application.


Who has access to your personal data and to whom are they transferred?


Within GeoBirds, your personal data is accessed only by staff who need it to perform their role, such as customer support, engineering, and commercial staff. The controller of your personal data is:

We may share your personal data with the following third parties:

  • Cloud hosting and infrastructure providers, specifically Google Cloud, which we use to run our platform and our business;

  • Content delivery and security providers, specifically Cloudflare;

  • Customer relationship management and marketing providers, specifically HubSpot;

  • Email delivery providers, specifically Flowmailer;

  • Accounting and invoicing providers, specifically Exact Online;

  • Login, product analytics and customer engagement providers, specifically Clerk, Segment, Customer.IO and PostHog;

  • Web data collection providers, which we use to retrieve professional profile information when a customer asks for contacts associated with a site;

  • Professional advisers such as accountants and lawyers.

The above third parties are contractually obliged to protect the confidentiality and security of your personal data, in compliance with applicable law. Your personal data can also be accessed by or transferred to any national or international regulatory, enforcement, or public body, or court, where we are required to do so by applicable law or regulation or at their request.


International transfers. We run the GeoBirds platform on Google Cloud and store your account data and the data you provide or generate in the platform on Google Cloud services located in the Netherlands. The supporting systems we use to operate our business and our platform, such as customer relationship management, login, email delivery and product analytics, store personal data within the European Union. Some of the providers of those systems belong to groups with companies outside the European Economic Area, and their staff or sub processors may access personal data from outside the EEA for support, maintenance and security purposes. Any such access is covered by appropriate safeguards, being the European Commission Standard Contractual Clauses or, where applicable, an adequacy decision of the European Commission.


Where we retrieve professional profile information at a customer's request, as described in the section Professional contacts shown in the GeoBirds platform, the request is handled by a service provider located outside the European Economic Area. That transfer is covered by an adequacy decision of the European Commission or by Standard Contractual Clauses.


What personal data does GeoBirds store and process?


GeoBirds stores and processes the categories of personal data described in the section What personal data we collect above. In summary these are:

  • account and profile data;

  • communications and support data;

  • usage and technical data;

  • business contact and prospect data.


The GeoBirds platform is built primarily to analyse geospatial and logistics data about sites, facilities, and freight flows, which generally does not identify individuals. Personal data plays a limited role in the platform, and is mainly limited to your account, your use of the application, and the business contact details described below.


Automated decision making and profiling. The GeoBirds platform uses artificial intelligence, computer vision, and machine learning to analyse satellite imagery and logistics trade data and to predict freight activity at logistics sites. This analysis concerns locations, facilities, and freight flows. GeoBirds does not use your personal data to make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you. We do not score, rank or profile named individuals.


Professional contacts shown in the GeoBirds platform


When a GeoBirds customer is interested in a particular logistics site, we can show them business contact details of professional contacts at the organisation located at that site. We retrieve this information from professional profiles published on the public web at the time the customer asks for it. We do not maintain our own database of these contacts and we do not keep them after the request has been answered.


Categories of personal data: name, job title, employer, professional profile link, and business email address.


Source: professional profiles published on the public web, retrieved through a specialist web data collection service acting on our instructions.


Legal basis: our legitimate interest, and the legitimate interest of our customer, in identifying relevant business contacts at organisations they wish to approach.


You can ask us for a summary of our assessment of that interest. Where we keep a suppression record following an objection, we do so in order to comply with our legal obligation to give effect to that objection.


Recipient: the GeoBirds customer who asked us for the contact details. Once we make your details available to that customer, the customer decides how to use them and acts as an independent controller of your personal data.


Retention: we do not retain the contact details after the request has been answered. If you object, we keep a minimal suppression record consisting of your professional profile address and the date of your objection, so that we can recognise and block any future request relating to you. We keep that record for as long as we operate this feature, and we do not use it for any other purpose.


Your right to object: you can object at any time by emailing privacy@geobirds.io. We will add you to our suppression list, after which your details will no longer be retrieved or made available through the platform. Keeping that limited record is the only way we can give lasting effect to your objection.


How do we protect your personal data?


We take appropriate technical and organisational measures to protect your personal data against loss, misuse, unauthorised access, disclosure, and alteration. These measures include encryption in transit and at rest, access controls and authentication, network security, logging and monitoring, and regular backups. We host the GeoBirds web application and store your account and platform data on Google Cloud, using services located in the Netherlands. Access to personal data is limited to authorised personnel and service providers who need it. Human access to our Google Cloud environment is limited to named individual accounts protected by two factor authentication, and the same requirement applies to any contractor or external developer who works on the GeoBirds platform on our behalf.


How long does GeoBirds keep your personal data?


We keep your personal data only for as long as necessary for the purposes for which it was collected, and to comply with our legal obligations.

  • Account and platform data: for the duration of your account or the customer agreement, and for 12 months afterwards;

  • Billing and administrative records: 7 years, in line with the retention obligation under Dutch tax law.;

  • Business contact and prospect data: until you object or, where consent applies, withdraw it, or after 24 months of inactivity;

  • Suppression records: for as long as we operate the feature to which the objection relates.

  • Website and technical data: 14 months;

Once the applicable period has expired, we securely delete or anonymise your personal data.


What are your rights and how can you exercise them?


Under the GDPR, you have the following rights in relation to your personal data:

  • The right of access: you can request a copy of the personal data we hold about you;

  • The right to rectification: you can ask us to correct data that is inaccurate or to complete data that is incomplete;

  • The right to erasure: you can ask us to delete your personal data, under certain conditions;

  • The right to restrict processing: you can ask us to limit how we use your personal data, under certain conditions;

  • The right to object: you can object to our processing of your personal data, including for direct marketing. If your business contact details were shown to one of our customers through the platform, you can object using the details in the section Dedicated point of contact, and we will add you to our suppression list so that they are no longer retrieved or made available;

  • The right to data portability: you can ask us to transfer your personal data to you or to another organisation, under certain conditions;

  • The right to withdraw consent: where processing is based on your consent, you can withdraw it at any time, without affecting the lawfulness of processing before withdrawal.


To exercise any of these rights, please contact us using the details in the section Dedicated point of contact below. We will respond within one month. In complex cases we may extend this by a further two months, and we will tell you if we do. You also have the right to lodge a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl), or with the supervisory authority in your country of residence.


If you have agreed to receive marketing communications from us, you can opt out at any time by clicking the unsubscribe link in our emails or contacting us.


Cookies


The GeoBirds website and web application use cookies and similar technologies, including local storage and session storage. A cookie is a small text file placed on your device when you visit a website.


Some cookies are strictly necessary for the GeoBirds web application to work and to keep your account secure. We use Clerk to log you in and maintain your session, and Cloudflare to protect our infrastructure against bots and abuse. These cookies cannot be switched off and are placed without your consent, because the platform cannot be delivered without them. They last for the duration of your session or up to twelve months.


With your consent, we also use analytics cookies to understand how the website and the web application are used so that we can improve them. For this we use Segment and PostHog, which assign a visitor identifier, link usage events to your account, and record which features are used and how the application performs. These cookies last up to twelve months.


When you first visit our website we ask for your consent for analytics and marketing cookies. You can change or withdraw your consent at any time through the cookie settings on our website. You can also manage or disable cookies through your browser settings, although some features may not work as a result. Disabling strictly necessary cookies will prevent you from logging in to the GeoBirds web application.
